General Conditions, current as at July 2022

The website https://wholesaleplus.com.au/ (the “website”) is owned and operated by Wholesale-Plus, and referred to as Wholesale-Plus, “We”, “our”, “us” or the “Company”. The Company include representatives, subsidiaries, affiliates, related parties, officers, directors, employees, agents, independent contractors, advertisers, partners and co-branders. “You” and “your” means the user or customer of this website.

Your use of the website constitutes your agreement to abide and be bound by these Terms and Conditions. If you do not agree with the Terms and Conditions, please do not use the website.

Order and Cancellation

You must be at least 18 years old to place an order with Wholesale-Plus.  

You shall pay for the product in full when you place an order, by supplying us with your credit, debit card details or by paying through PayPal. In any event, we shall not be bound to accept the order before we have received and cleared the payment in full.

When you submit an order through the website, you agree to abide and be bound by the prevailing Terms and Conditions. We are not obliged to supply the product until we have accepted your order. An acceptance of your order with your order details will be sent to you. Wholesale-Plus reserves the right to decline any order, for any reason. If order has been declined, you will be provided a store credit or a full refund, depending on your preference.

If payments are made on the weekend or public holiday, the order will not be processed until the next business day.

Pricing

All prices are quoted in Australian Dollars and GST are inclusive.

Wholesale-Plus reserves the rights to change prices for products displayed at our website at anytime without notice. We make every effort to ensure the accuracy of our pricing. However, if an error occurred, we reserve the right to refuse to accept further orders and to cancel any orders already placed at the incorrect price.

Sale of Good and Delivery

We only deliver to Australia at present.

The information on this site is intended and applicable for Australian consumers only.

Items will be delivered to the address you nominated while placing your order. We are not liable for late or missing deliveries if an incorrect address is given.

With a 15% restocking fee, you have the option to return any unopened, unused item in its original packaging that you bought from Wholesale-Plus for any reason within 14 days of receiving the item.

Estimated shipment times may change due to changes in supply or conditions beyond our control. If you have not received your items within the estimated delivery time, please contact us via email or phone.

Product Review Messages

Wholesale-Plus welcomes feedback on our products from you. As a courtesy, we ask that you do not use obscene, profane or threatening language in messages. You are solely responsible for your messages and we are not liable for any content submitted by you. We reserve the right to remove the content you submit at any time.

Damage or Faulty Returns

You shall notify Wholesale-Plus within 2 working days in the unlikely event that your item arrives damaged or faulty. In addition to a detailed description, you are required to provide images (or a short video clip if more appropriate) of the damage in order to proceed with the warranty process. Once assessed and approved by our customer service team, you will be contacted to proceed with the return, refund or replacement process. Please do not attempt to return the item without approval by us.

A refund or replacement will not be provided if products are being misused, mishandled or mistakenly installed. Customers are responsible for following the instructions and advice given by the manufacturers.

Warranty for products sold through Wholesale-Plus

    1. All products sold through the Wholesale-Plus Platform come with guarantees that cannot be excluded under the Australian Consumer Law, and our Warranty Policy does not limit any rights and remedies a customer may have under the Australian Consumer Law.
    2. In addition to a customer’s rights under the Australian Consumer Law, Wholesale-Plus offers a 12-month warranty on products sold through the Wholesale-Plus Platform which are found to be faulty or damaged, except (and subject to the Australian Consumer Law):
      1. if expressly stated otherwise on the product listing – please refer to the product listing for the express warranty period.
      2. in relation to accessories or bonus gifts (as noted as such in a product listing); or
      3. if the fault or damage is due to:
        1. normal wear and tear
        2. damage arising from improper assembly or modification of the product.
        3. damage arising from abnormal use or abuse of the product.
        4. damage, wear and tear as a result of improper or lack of maintenance and/or care of the product (e.g., of fabric, leather or timber); or
        5. damage to external product packaging only.
    3. We will assess each warranty claim on a case-by-case basis. Depending on the nature of the damage or fault, we may arrange to:
      1. send missing parts (if applicable).
      2. suggest a method of self-repair (if applicable).
      3. replace the product (subject to availability).
      4. offer an alternative product; or
      5. offer a partial or full credit voucher or refund.

Making a warranty claim for damaged goods or missing parts.

    1. Warranty claims should be sent to us via Wholesale-Plus website - “Contact Us page”.
    2. The following should be included in the message:
      1. order number.
      2. the quantity of each product and/or part missing, faulty or damaged; and
      3. an image or video (of acceptable quality) of the product that clearly shows:
        1. the fault or damage (if applicable)
        2. what part is missing (if applicable);
        3. the product in the original packaging (if applicable); and/or
        4. the product’s instruction manual with the fault or damage and/or missing part indicated, for example by circling the area damaged or from which a part is missing (if applicable). In addition, please provide a brief explanation of the fault or damage, and what the customer is requesting, i.e., refund, credit or replacement of parts/product.
    3. All images and videos should be of acceptable quality that allows us to assess the claim – thumbnail images are not considered to be acceptable quality as we cannot make a clear assessment of alleged faults or damage.
    4. A customer should not dispose of items before a warranty claim has been made and finalised, as we may ask for items to be inspected. We reserve our rights, subject to the Australian Consumer Law, to not provide a credit, replacement or refund in cases where goods are disposed of by the customer before a warranty claim has been finalised.
    5. Please do not ask customers to return the product to us or suppliers unless instructed to do so. If we need the product returned, we will provide a return label for this purpose. Any postage cost incurred by the customer for return postage will not be refunded if it is found that there is no valid warranty claim and/or and the return label has not been provided.
    6. For missing parts, once we have received the necessary details, and validated the claim, we will issue the part to be dispatched to the customer as soon as practicable after we have confirmed the spare part is available for dispatch. Dispatch of spare parts from our warehouse can take up to two working days. If no spare part is available in a reasonable period, we will provide an alternative solution in-line with our obligations under the Australian Consumer Law.
    7. Any delivery delay should be reported by you to us within 30 working days from the date of dispatch. Any delivery delay will be investigated by our courier partner, which can take up to two working days. If we receive no update within two working days of notifying the partner, we will offer an appropriate remedy in accordance with the Australian Consumer Laws. Due to ongoing COVID restrictions in place in different states and unforeseen occurrence of natural disasters from time to time, delivery time frames can be affected. Your patience in such cases would be highly appreciated.

Refund, return and replacement procedure for damaged/faulty goods or missing parts.

    1. If a customer is entitled to a refund, please send the request via Wholesale-Plus website - “Contact Us page”., and we will advise if the product needs to be returned by the customer. Refunds will be issued to the original payment method. We cannot issue refunds to a different account or credit card to that used to place the relevant order.
    2. If a customer is entitled to a replacement or spare part, please send the request via Wholesale-Plus website - “Contact Us page”, and we will advise if the product needs to be returned by the customer. If a customer is entitled to a replacement product or spare part, but:
      1. there is an address discrepancy with the order (which is due to your or the customer’s error) such that the product/part is returned to us, a cost of Return to Sender (if applicable) and re-delivery cost will be imposed by us on you for any products returned to us as the sender; and/or
      2. an incorrect product is returned to either Wholesale-Plus’s or the Supplier’s warehouse, neither Wholesale-Plus nor the Supplier will be responsible for these products or have any obligation to return these to the customer.

Product recalls

    1. In the event of a product recall, we will advise you of the relevant procedure.

 

Internet Communication

Wholesale-Plus reserves the right to email you our product updates and newsletter that we believe may be in your interest. At the same time, we respect your right not to receive these communications from us. Please advise us at the time of placing your order if you do not wish to receive any updates, and we will disable the option for your account. 

Intellectual Property Rights

The site and its content is protected by copyright which is owned by Wholesale-Plus, or in the case of some content, by a third party. You can browse the site freely and print it out for personal or non-commercial use. Registered trademarks and logos must not be used or modified in any way without obtaining the prior written consent of us.

Correction of Errors and Inaccuracies; Limitations on Quantity

Wholesale-Plus makes every effort to ensure accurate product descriptions. However, the content may contain typographical, technical or descriptive errors; and may not be complete or up to date. Therefore, we reserve the rights to correct any information at any time without prior notice. We also reserve the right to limit quantity, including after order is submitted or paid for. We apologise for any inconvenience caused.

We endeavour to display the colours of the products on the website as accurately as possible. The colour of the product you see depends on your monitor, so it is not guaranteed that there is no colour deviation from the actual product.

Website Access

Due to random technical errors, we do not guarantee all-time access to the web site. The Terms and Conditions do not guarantee that we will continue operating all or any part of the website. It is not our liability if the website is closed down or modified at any time.

Limitation of Liability

We are not liable if products are being misused, mishandled or mistakenly installed. Our maximum total liability for any product supplied to you shall at no time exceed the amount you pay to us in respect of the product.

Indemnification

You agree to indemnify, defend, and hold harmless Wholesale-Plus, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorney's fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Amendment

We reserve the rights to amend the Terms and Conditions at any time without notice. You should check the terms and conditions regularly. Continued use of the website will be deemed to constitute your acceptance of the updated Terms and Conditions.
